RENTAL AGREEMENT

This Agreement sets out the terms for the rental of vehicles (cars, scooters, and off-road buggies) and is governed by the laws of the Republic of Cyprus. All sections are binding.

1. DEFINITIONS

1.1. "Agreement" – This document and any supplementary materials provided during rental.
1.2. "You" / "Your" – The renter, any co-signer, authorized driver, or payer.
1.3. "We" / "Us" / "Our" – The rental company Rentamania Ltd.
1.4. "Authorized Driver" – Any driver listed in this agreement by us, aged 21+, holding a valid license.
1.5. "Vehicle" – The rented car, scooter, or buggy, including keys, tools, accessories, documentation, and equipment.

2. RENTAL TERMS

2.1. This is a rental agreement for temporary use of the Vehicle.
2.2. No warranty of fitness or merchantability is expressed or implied.
2.3. We may repossess the Vehicle without prior notice if it is misused, abandoned, or used in breach of this Agreement or law.

3. VEHICLE CONDITION & RETURN

3.1. You must return the Vehicle in the same condition as received, except normal wear and tear, on the agreed date, time, and place.

3.2. Additional charges apply for:
 • Excess dirt or salt requiring detailing – €100 per affected area
 • Smoking in the vehicle – €50 cleaning fee
 • Unreported damage or missing items – billed as assessed

3.3. Prohibited Use of Vehicle:
Use of any vehicle, except for specifically approved off-road buggies and ATV/UTV vehicles, on any unpaved or off-road surface is strictly prohibited. This includes dirt roads, beaches, forest paths, mountain trails, dry riverbeds, or any other surface not covered by asphalt.
Additionally, entry into the following areas is prohibited without prior written approval: Akamas Nature Park, Adonis Baths, Akrotiri, Cavo Greco, Ladies Mile, Avakas Gorge, White River Beach, as well as any occupied territories (Northern Cyprus).
— Penalty per violation: €300
Violation of these restrictions may also result in full liability for damage and voidance of insurance coverage.

3.4. Transfer of Risk and Responsibility:
All risks and full financial responsibility for the Vehicle remain with the Renter until the Vehicle is physically inspected and accepted by an authorized representative of the Company at the designated return location.
Only upon official acceptance by the Company’s representative does the liability for the Vehicle transfer from the Renter to the Company.

3.5. Unauthorized Return / Abandonment
Returning the Vehicle at any location or in any manner other than agreed in writing (including leaving the car unattended and/or dropping it at an airport or third-party car park without our approval) is prohibited.
Relocation/Recovery Fee:
• within Paphos district – €150 flat,
• intercity (incl. Larnaca / Ayia Napa / Limassol / Nicosia) – €300 flat + €1.00/km outside 40 km,
• plus all third-party costs (towing, parking, access fees) and an Administrative Fee €25 per external invoice.

3.6. Keys / Keyless Fobs / Documents (Loss or Non-return)
The renter must return all keys/fobs and documents to our staff.
Fees: replacement key/fob €250 each + €150 programming/immobilizer re-coding (or actual invoice if higher), lock-set replacement at cost, plus any call-out/towing as needed.

3.7. Responsibility Until Physical Repossession
The renter remains liable for the Vehicle, all risks and charges until the Vehicle and all keys are physically received by RentaMania or our authorized agent, regardless of where the car was left.

3.8. Loss of Use
If the Vehicle is unavailable due to unauthorized return/abandonment or missing keys, loss of use is charged at the daily contract rate (or €55/day, whichever is higher) until recovery and the Vehicle is back in service.

3.9. One-way Drop Without Approval
Unauthorised one-way drop is a contractual penalty €200 per incident in addition to actual costs under 3.4–3.8.

4. MAINTENANCE & DAMAGE

4.1. You are responsible for checking fluid levels and overall care of the Vehicle.
4.2. All accidents must be reported immediately to both the police and us.
4.3. You are liable for:

• Loss of use

• Diminished value

• Administrative handling

• All recovery and repair costs not covered by insurance

5. INSURANCE & LIABILITY

5.1. The Vehicle is insured for third-party liability in accordance with Cyprus law.
5.2. Optional coverage (e.g. CDW) may be offered for damage to the Vehicle.
5.3. In case the renter accepts CDW (Collision Damage Waiver), a deductible/excess of €300 applies. The renter remains fully liable for any damage up to this amount.

5.4. Insurance becomes void and fully inapplicable if the Vehicle is operated:

• By any unauthorized driver

• Under the influence of alcohol or drugs

• On any off-road, dirt, unpaved, or non-asphalted terrain

• In any of the following zones without our prior written approval:
  Akamas Nature Park, Adonis Baths, Akrotiri, Cavo Greco, Ladies Mile, or any occupied territories (e.g. Northern Cyprus)

• Overloaded beyond seating capacity

• For commercial or prohibited use (e.g., taxi, delivery)

• With negligence or reckless behavior (e.g., racing, leaving keys in ignition)

In such cases, you are fully liable for all damages, third-party claims, recovery, towing, and legal costs.

6. CHARGES & DEPOSIT

6.1. Charges you agree to pay include:

• Daily rental rate

• Optional equipment (e.g. GPS, child seats)

• Traffic and parking fines

• Cleaning, damage, or penalty fees

• Administrative fees for violations

• Speeding penalties under Clause 12.5–12.7

6.2. A refundable deposit is held as security and may be used to cover any unpaid amounts.
6.3. Overdue charges accrue interest and collection costs.

6.4. Card-on-File / MIT
The renter authorizes merchant-initiated transactions to recover amounts due under Clauses 3.2–3.9, Clause 12.5–12.7, fines, third-party charges and administrative fees, as detailed in the Card-on-File Authorization.

7. MINIMUM AGE & LICENSE REQUIREMENTS

7.1. The minimum age for rental is 21 years.
7.2. A valid driving license held for at least 2 years is required.
7.3. For scooters, a Category A or equivalent license is mandatory.

8. RENTAL DURATION

8.1. Minimum rental period is 24 hours.
8.2. Early return does not entitle the renter to a refund.
8.3. In case of late return beyond the agreed time, an additional fee of €10 per each hour of delay will be charged.

9. MODIFICATIONS

9.1. No clause in this Agreement can be altered without written consent signed by an authorized representative of Rentamania Ltd.

10. TERMINATION

10.1. We reserve the right to terminate this Agreement and repossess the Vehicle at your expense in the event of:

• Any breach of terms

• Illegal use

• Violation of traffic or territorial restrictions

11. ENTIRE AGREEMENT

11.1. This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, communications, or representations.

12. GPS MONITORING

12.1. For safety, compliance, and operational reasons, all vehicles rented under this Agreement are equipped with active GPS tracking devices.

12.2. By signing this Agreement, you acknowledge and consent to the use of GPS technology to monitor vehicle location, route history, and usage patterns for the duration of the rental period.

12.3. Data collected through GPS may be used to:

• Verify compliance with contractual terms (e.g., territorial restrictions, driving behavior),

• Support investigation in case of accidents, damage, theft, or loss,

• Impose penalties for violations such as unauthorized travel or reckless driving.

12.4. Evidence obtained via GPS tracking is admissible for enforcing penalties, including but not limited to those listed under Section 3.3, Section 5.4 and Clause 12.5–12.7 of this Agreement.

12.5. Speed Limit Compliance
You must comply with posted speed limits at all times. Where GPS/telematics data indicates speeding, we may apply contractual penalties as set out below. These contractual penalties are independent of, and do not replace, any official fines/penalties imposed by authorities.

12.6. Speeding Penalty Schedule (Contractual Penalties)
For the purposes of this Agreement, a “Speeding Incident” is a recorded event where the Vehicle exceeds the applicable speed limit by 10 km/h or more.
The contractual penalty is calculated based on the km/h above the speed limit:

• Up to 30% above the limit: approximately €2 per 1 km/h above the limit

• 31% to 50% above the limit: approximately €3 per 1 km/h above the limit

• 51% to 75% above the limit: approximately €5 per 1 km/h above the limit

• More than 75% above the limit: the incident may be treated as a serious breach; we may report it to the authorities and recover our losses and charges. Any contractual penalty in such case is assessed based on the circumstances and actual costs.

12.7. Recovery of Speeding Penalties
Speeding penalties may be recovered from the deposit and/or charged via Card-on-File / MIT under Clause 6.4.

Annex 1 – Damage Pricelist

By signing this Agreement, the renter acknowledges and accepts the following indicative charges for vehicle damage, cleaning, or loss. These amounts are guidelines and may be adjusted if actual repair costs are higher.

Annex 2 – Scooter/Moped Damage Pricelist (KYMCO Agility 125cc)

By signing this Agreement, the renter acknowledges and accepts the following indicative charges for scooter/moped damage, cleaning, or loss. These amounts are guidelines and may be adjusted if actual repair costs are higher.

BY SIGNING BELOW, YOU CONFIRM THAT YOU:

• Have read, understood, and accepted all the above terms

• Accept responsibility for all charges and potential liabilities

• Acknowledge that violation of usage terms may void insurance

• Agree to penalties as outlined, including €300 fines for unauthorized travel and speeding penalties under Clause 12.5–12.7
